Burglar dies after homeowner puts duct tape on his mouth and ties him to a tree

Suspected burglar dies after Alabama homeowner catches him breaking into his house, puts duct tape on his mouth and ties him to a tree
    • Deputies said Nathanial Johnson, 68, caught Cleveland Jones Gully, 31, breaking into back door of his Alabama home on Friday night
    • He chased Gully out of the house and then the intruder either fell or jumped off the back steps, authorities said
    • Johnson jumped on him, tied his hands behind his back, put duct tape on his mouth and tied him to a tree with masking tape and clothesline
    • He then called 911 and when sheriff's deputies arrived about 10 minutes later, Gully was dead
    • Autopsy will be performed and no charges have been filed yet against Johnson
Authorities said a suspected burglar is dead after an Alabama homeowner tied him to a tree after catching the man breaking into his home.

Washington County Sheriff Richard Stringer said 68-year-old Nathanial Johnson caught 31-year-old Cleveland Jones Gully breaking into the back door of his home, about 60 miles north of Mobile, on Friday just before midnight, AL.com reported.

Johnson, who told deputies his home had been robbed previously, had set up a trap that night in an effort to stop any more burglaries from taking place at his mobile home.

So he turned off the lights and parked his car at a neighbor's home to make it seem like no one was there and went back to his house where he waited inside by the back door, WALA reported.

He eventually heard someone knocking on the front door, Stringer said.

After he did not answer, the suspect then made his way to the back door where he broke the lock around 10pm, according to WALA.

Stringer said Johnson chased Gully, who reportedly has a reputation for breaking into homes, outside and Gully then either fell or jumped off the back steps.

Johnson tackled him to the ground, tied his hands behind his back, put duct tape on his mouth and tied him to a tree using insulated electrical tape and clothesline.

'He began to tie him to the tree still in the standing up position,' Stringer told WALA.

Johnson then left his home to go to a neighbor's house where he called 911.

However, when sheriff's deputies arrived about 10 minutes later, Gully was dead.

Stringer, who called the case 'very unusual' said Gully did not have any visible injuries apart from cuts on his body from the wire.

He said an autopsy will be performed to determine the cause of death.

'I don't think he was intending to kill the intruder,' Stringer told WALA. 'I think he wanted to capture him and have him arrested.

Gully's uncle said he is still in shock following his nephew's death, telling the station that Gully 'wasn't a violent person that I know of.'

Meanwhile, Johnson's niece, Simone Johnson, described her uncle as a man who 'doesn't bother anybody.'

'He'll help you if you need helping, so the family just hates what happened,' she told WALA.

'I know the other guy. His family is hurting too, but we are also and we hate that, and I hope that we can just get this resolved soon.'

At this time, no charges have been filed against Johnson.

Was the tape over the mouth and nostrils? Tape just over the mouth will suffocate those with blocked sinuses.

Would it be too callous of me to say "oh well"? Or should I jump right to "So what did we learn?!?!?!?". Although I guess the answer to that question for the scumbag trying to break into a 68 year olds home is "Nothing, cause now you're not here anymore.... Jackass."

Good for Johnson. He should get a key to the city for taking care of someone who has a history of breaking into homes.

Admitting to setting him up and not answering the door might not work out for him. If this happened here, he'd already be in Rikers.

I don't know.... Not answering the door doesn't give someone carte blanch to try to break a lock to enter the home. If I want to sit there and ignore my doorbell, I can and sometimes do. I guess you're thinking of the situation like an entrapment scenario but I don't see it that way. The door wasn't unlocked, there was no open invitation to the premises, etc.

Agree with your assessment of Johnson being in Rikers by now if that occurred here.

              We learned several things:
              1) I laughed my ass off that a 31 year old POS got his ass beat by a 68 year old man and tied up
              2) Duct tape is awesome
              3) Alabama is a better place to live than NY
              4) Dirtbags often go by 3 names
              5) I'm still laughing at poor Cleveland.
              6) Fuck Cleveland

Why did the homeowner go to his neighbor to call 911?

You have to take into consideration that Pate was talking about NY.
In New Yorkastahn, I believe the homeowner would be in deep trouble for saying that he parked his car away and turned is lights off to catch a burglar.
I'm pretty sure the'd be charged.
Luckily Mr Johnson is black, otherwise the BLM and liberal douches would be calling this a lynching on a tree.

To give time for the duct tape to work?

Oh I get that. I still think it would be a hard sell to prosecute for any kind of entrapment or setting the guy up type of charge but yeah, poor old homeowner would be facing some sort of manslaughter charge for not just running away to a "safe" place. Then we would have a "ban duct tape" march in NYC. And home ownership ban.

New Yorkastahn made me chuckle btw. Thanks for that... :-)

I wouldn't consider this a trap 'per se', just creating the appearance of nobody home isn't illegal.. Digging a hole and setting poisoned spears or a door deadfall upon entering, that is lethal, is a trap and probably going to cause more trouble to the homeowner in the long run than it's worth.
