    suffolk county - semi auto rifle w/o pistol license

    Sorry if this is lined out somewhere - for a suffolk resident WITHOUT a pistol permit, can you still get a semi-auto rifle - and if so what exactly do you have to do?

    call the SCPD pistol bureau and make sure you ask for the name and write it down of whomever you speak with.
    I say that because it seems to me shit chamges and the government keeps us guessing.
    Anything you get told here will be old news.
    They have to know what the most recent procedure is.

    That said, I would think there may be some guys here that have some info and I'm curious as to what the current procedure is myself but I'm not buying anything.
    If i were I;d want to know what they say the day before I buy it to make sure I don;t get screwed.

      thank you - i know this is all mind numbing topics to bring up - and i toto dont want to buy anything under these conditions but in the event i found something that was a real great deal / rare that i couldn't say no to - wanted to know

    Drive to PA or VT and buy it there; the law only prevents you from buying in NY, it DOES NOT prevent you from possessing in NY which would include legally purchasing in a contiguous state (as long as it's NY compliant) and transporting it home

      That's not going to work. The law prevents transfer to an unlicensed recipient.
      Gun will need to be shipped to a NY FFL at which point transfer rules apply to receiving dealer.

    File for a pistol permit and rot at home while waiting for it.

      SCPD is treating semi auto rifles as pistols. They cannot be purchased unless the Suffolk County resident has a pistol permit. And the rifle is to be added to the permit using the purchase document procedure. It is fucking bullshit.

      An FFL in PA wouldn’t sell me a semi auto rifle as a NY resident. He told me ATF is auditing to ensure FFLs follow rules of out of state purchases and we’re told not to sell without the semiauto endorsement on our pistol permits.

        Interesting on the "semi-auto endorsement". Last month I spoke to a woman at SCPD PLB and asked specifically about some type of endorsement for semi-auto long arms and was told there is no such endorsement and the semi-auto long arm would just be added to our card like any pistol. She also said they have not been advised any other way to manage this. Unreal with the guessing game here.

        Sadly this is a situation where Suffolk doesn't understand the business or the federal laws at all. The State law mentions a SA Rifle Permit, so by refusing to create such a thing, Suffolk has made the mess that its residents are trapped by. They need to put it in writing that a Pistol Permit is simultaneously a SA Rifle permit, or they are ignoring State law and harming their residents.

            ATF? I thought they didn't get involved in local laws. Or is his story just like what I keep hearing about "black ATF vans" at Calverton.

              ATF does not give a fuck about local laws. HOWEVER, it is their job to ensure that FFLs follow the federal laws that say that dealers can only sell to out-of-state residents face-to-face if the sale is legal in both jurisdictions, that is both the FFL's and the buyer's.

              I should add that I have never had the ATF check my books about that kind of thing... but the agents remind of us these rules at every contact. The agents I have met on the job have never been less than professional, and are never looking to jam up a straight dealer. They are bureaucrats however, and they do expect the rules to be followed, so they remind us about these rules all the time to help keep us out of trouble.

            Excuse me????!!!! “Stories” ????!!!! My sister-in-law’s, brother’s, cousin’s (three times removed by marriage), uncle heard from a friend of a co-worker that his plumber’s kid saw a black SUV in the parking lot at Calverton… and it looked very suspicious.

            True story though, one time we were shooting next to a DEA agent who said he was also ex-ATF. He was missing a thumb that he said was blown off by an M203 going kaboom during a drug raid in some South American shithole. He had all sorts of fully auto and select fire goodies that he was kind enough to let us shoot. Nellie (?) started yelling about rapid fire, he flashed his ID and she went away mumbling.
