    Federal Agency: Wearing ‘Don’t Tread on Me’ Gadsden Flag Symbol Might Be Actionable Racial Harassment

    The Equal Employment Opportunity Commission is looking into whether wearing a depiction of the Gadsden flag to work should be considered racial harassment after a black employee at a privately owned business filed a complaint with the federal agency more than two years ago.

    The complaint was filed by the black worker in January 2014 after he said one of his coworkers wore a hat depicting a coiled snake with the words “don’t tread on me” repeatedly since the fall of 2013. The complainant did not allege, however, that the employee wearing the hat ever said anything racist to him, the Daily Caller reported.

    The complainant said that he made his concern known to his bosses, who then asked the employee to stop wearing the hat. The worker in question kept wearing the hat, however, resulting in the offended employee filing a formal complaint with the EEOC, which oversees issues of discrimination in the workplace.

    “It is clear that the Gadsden Flag originated in the Revolutionary War in a non-racial context,” the agency stated in a preliminary ruling, according to the Washington Post. “Moreover, it is clear that the flag and its slogan have been used to express various non-racial sentiments, such as when it is used in the modern Tea Party political movement, guns rights activism, patriotic displays and by the military.”

    The agency went on to say, “However, whatever the historic origins and meaning of the symbol, it also has since been sometimes interpreted to convey racially-tinged messages in some contexts,” citing at least two more recent controversies over the flag. The first was that of two Las Vegas police officers whose bodies were draped with the yellow banner after their murders. The second was a incident in which New Haven, Connecticut, firefighters claimed the flag being displayed at work constituted racial insensitivity.

    “In light of the ambiguity in the current meaning of this symbol, we find that Complainant’s claim must be investigated to determine the specific context in which C1 displayed the symbol in the workplace,” the EEOC concluded.

    The agency’s investigation into the matter is ongoing. A representative for the EEOC did not immediately respond to a request for comment.

      So let me get this straight, they say the flag has NO racial connection in history. It's connection to race is just make believe in the minds of a few seeing it, and they are thinking about considering it racist to display it. This country sinks deeper into the cesspool each day.

        So let's see here. The flag that adorned this countries first Navy vessels proclaiming don't walk on us all regardless of race or religion is a crime to wear but a flag boasting BLM and the logo what do we want? DEAD COPS is OK. I also don't think it's a crime to wear an Isis flag t-shirt. This country is so fucked up.

          Well .... I wonder how far the EEOC would have considered the meaning of rainbows... if a White Christian Male's complaint of religious harassment by a member of the LGBTXYZ community wearing a rainbow hat at his place of work refused to stop wearing hat after being told it was offending someone.

          or they could have just googled Gadsden flag .... and found out 1. there is no racial component to the meaning.... and that a number of US States use the flag on vanity plates....

          But to me the timing of the complaint is contemporaneous to the bullshit up rise over the confederate battle flag ...

              Uhh, the Gadsden Flag isn't even remotely related to anything. It was used during the Revolutionary War. So what the fuck?

                    sound like hr at that company needs to have a history class and or post a google link for the quote "don't tread on me" as for the douche ranger who filed the complaint waaahhhh waaahhhh somebody wore something I don't like so now let me make a big ordeal about it, effing tool, somebody should complain that the shoes he is wearing are offensive

                        They socialists are looking to deconstruct American society and erasing our history. . They're telling us how to speak, what to wear, which bathroom to use and which flag you can fly.
                        Exercise the Bill of Rights. It's good for your Constitution.
