    LEOs...a stopped school bus question

    LEOs...I have a stopped school bus question for you.

    The scene would be a 4 way intersection, stop signs at each corner.

    A school bus is at the stop sign, headed South. it is stopped, with it's red lights flashing & picking up kids.

    A North bound car approaches the intersection, across from the bus.

    After making a complete stop, at the stop sign, is the car allowed to proceed to make a left or right turn?


    If Sonny had EZ-Pass, he'd have survived that hit...

    IMO....If the Red Light are flashing just stay right where you are.
    No turns allowed.

      I would say yes, with the caveat that there are no other circumstances that would disallow the car from turning.

        That's what I would do. But I have seen others say you are allowed to turn, because you are not passing the stopped bus.

            In New York you are required to stop for a school bus with flashing lights even on the opposite side of a divided highway. So I would assume you would have to stop in this scenario.

              If you were going top have to pass the bus, I'd agree, 110%. But the situation is that you are turning before & not passing the bus.

            § 1174. Overtaking and passing school bus. (a) The driver of a vehicle upon a public highway, street or private road upon meeting or overtaking from either direction any school bus marked and equipped as provided in subdivision twenty of section three hundred seventy-five of this chapter which has stopped on the public highway, street or private road for the purpose of receiving or discharging any passengers, or which has stopped because a school bus in front of it has stopped to receive or discharge any passengers, shall stop the vehicle before reaching such school bus when there is in operation on said school bus a red visual signal as specified in subdivision twenty of section three hundred seventy-five of this chapter and said driver shall not proceed until such school bus resumes motion, or until signaled by the driver or a police officer to proceed. For the purposes of this section, and in addition to the provisions of section one hundred thirty-four of this chapter, the term "public highway" shall mean any area used for the parking of motor vehicles or used as a driveway located on the grounds of a school or of a board of cooperative educational services facility or any area used as a means of access to and egress from such school or facility.

            The phrasing "either direction" to me, does not include adjacent streets. If it said "any direction", I would say that you could not turn.

            Comes down to letter of the law vs. intent of the law.

              You are not passing the school bus, so yes you may proceed. People who sit there on flashing yellow lights or fail to make a turn as you described are unaware of the law.

                100% ok, no doubt about it.
                Know your rights/Refuse peacefully to consent to a search /Ask if you are free to go or are being detained/Even if you are not doing anything wrong the 4th Amendment protects you against unreasonable searches/Never say anything to law enforcement even if you think it will help you/If questioned you should clearly and unequivocally request that you would like to have an attorney present and defer any questions until then/Never go to prison because you are afraid to go to jail.

                  It has nothing to do with passing the bus. It has to do with students crossing roadways. Lights will flash until students are safely across roads. That includes in front of the bus and to the sides, so any turn would be illegal.

                    In the scenario given, the bus was picking up, not discharging.
                    Even without a school bus, if there are people crossing, a car cannot proceed after stopping at a stop sign.
